This agreement governs the relationship between Pontium Pty Ltd (‘pontium’) and merchants who list products on the pontium.com.au platform. By creating a merchant account, you agree to these terms.
Merchants must hold a valid Australian Business Number (ABN). Merchants must operate a physical retail location or verifiable online store. pontium reserves the right to refuse or revoke merchant access at its discretion.
Merchants pay a monthly subscription fee based on store size and catalogue volume. Fees are communicated during onboarding and may be updated with 30 days written notice. There are no commissions on sales. There are no pay-per-click or affiliate fees. Subscription fees are billed monthly in advance.
Merchants are responsible for the accuracy of their product listings, including prices, product descriptions, and availability. Prices must reflect the actual in-store or advertised price. Deliberately listing inaccurate prices is a breach of this agreement. Listings with prices older than 90 days are automatically hidden from search results.
Product search results are ranked by price (lowest first) and distance from the consumer. No merchant can pay for improved ranking or preferential placement. This rule is absolute and applies equally to all merchants regardless of subscription tier or business size. Creating exclusive offers does not affect search ranking.
Consumers may report prices they believe to be inaccurate. Merchants will be notified of reports and are expected to respond within 7 days. Excessive unresolved price reports may result in a reduced trust score or suspension of listings.
pontium provides each merchant with a store profile page displaying business name, address, opening hours, contact information, and product catalogue. Merchants are responsible for keeping this information current.
pontium may provide merchants with aggregated, anonymised data about their listing performance, including views, comparison appearances, and price position. This data is provided to help merchants understand their market position. Consumer personal data is never shared with merchants.
Either party may terminate this agreement with 30 days written notice. pontium may suspend or terminate a merchant account immediately for breach of these terms, including repeated inaccurate pricing or abusive behaviour. On termination, merchant listings are removed from the platform. Any prepaid subscription fees for unused periods will be refunded on a pro-rata basis.
pontium does not guarantee any specific volume of traffic, leads, or sales from the platform. The platform is provided as-is. To the maximum extent permitted by law, pontium's liability to any merchant is limited to the total subscription fees paid in the 12 months preceding the claim.
This agreement is governed by the laws of Victoria, Australia.
